Reasons for current judicial policy regarding the use of arrest and imprisonment as punishment


Among the various reasons for which every 100th Russian citizen finds himself a prisoner, and practically every fifth (according to the most modest estimates) is being held under detention, or knows personally relatives or friends who have been in custody (including those placed under administrative detention or arrest), one can distinguish in contemporary judicial policy at least three circumstances which result in additions to and the mounting of the prison population:

  • State criminal policy

  • The neo-inquisitional character of criminal procedure

  • The sluggishness of court and investigative procedures
